Welcome to Moss & Myrtle. These Terms and Conditions govern your use of our website and the purchase of products from us. By accessing our website or making a purchase, you agree to be bound by these terms.
We are based in New Zealand, and these terms are governed by New Zealand law, including the Consumer Guarantees Act 1993, Fair Trading Act 1986, and Contract and Commercial Law Act 2017.

We strive to provide accurate descriptions and images of our plants and products. However, as plants are living organisms, actual products may vary slightly from images in terms of size, color, and appearance. We guarantee that all plants will be healthy and true to species.
All prices are listed in New Zealand Dollars (NZD) and include GST unless otherwise stated. We reserve the right to:
The price you pay is the price displayed at the time you complete your order. If a pricing error is discovered after your order, we will contact you to offer the option to proceed at the correct price or cancel the order.
All products are subject to availability. If a product becomes unavailable after you place an order, we will notify you as soon as possible and offer a suitable alternative or full refund.
All plants are inspected and guaranteed healthy at the time of dispatch. We provide care instructions with each plant. Following our care guidelines is essential for plant health after delivery. Our guarantee does not cover damage resulting from improper care after delivery.

Once you submit an order, you will receive an automatic email confirmation. This confirmation does not constitute acceptance of your orderβit simply acknowledges receipt. We reserve the right to decline or cancel any order before dispatch for reasons including product availability, pricing errors, or suspected fraud.
We accept the following payment methods:
All payments are processed securely through Stripe. We do not store your complete payment card details on our servers. Payment must be received in full before your order is dispatched.
Your payment information is encrypted and processed securely. We use industry-standard SSL encryption and are PCI DSS compliant through our payment processor, Stripe.
If payment fails, your order will not be processed. We will notify you by email and hold your order for 24 hours to allow you to update payment information. If payment is not successfully completed within 24 hours, the order will be automatically cancelled.
4.1 Delivery Areas β We deliver throughout New Zealand. International shipping is not currently available. Some remote or rural areas may incur additional delivery charges or extended delivery times.
4.2 Shipping Costs β Shipping costs are calculated based on delivery location, order weight and size, and selected delivery speed. Costs are displayed at checkout. We offer free standard shipping on orders over $150 to North Island urban areas and $200 to South Island urban areas.
4.3 Delivery Times:
Delivery times are estimates and may be affected by courier delays, weather conditions, or public holidays.
4.4 Tracking and Notifications β You will receive email notifications when your order is confirmed, dispatched (includes tracking number), out for delivery, and delivered.
4.5 Delivery Instructions β You can provide specific delivery instructions at checkout. While we pass these instructions to our courier partners, we cannot guarantee they will be followed.
4.6 Failed Delivery Attempts β After 3 failed delivery attempts, the package will be returned to us, and you may be charged a redelivery fee.
4.7 Damaged or Lost Parcels β If your parcel arrives damaged or goes missing during transit, please contact us within 48 hours of the scheduled delivery date.
5.1 New Zealand Consumer Guarantees Act 1993 β Under the Consumer Guarantees Act 1993, you have rights that cannot be excluded. All products must be of acceptable quality, fit for their intended purpose, and as described in our product listings.
5.2 Our Plant Guarantee β We guarantee that all plants are healthy and pest-free at the time of dispatch. If your plant arrives in poor condition, dead, or severely damaged, please contact us within 48 hours with photos. We will offer a full refund or replacement at no additional cost.
5.3 Change of Mind Returns β Due to the living nature of our products, we cannot accept change of mind returns for plants. For non-living products, you may return items within 14 days if unused, in original condition and packaging, with proof of purchase.
5.4 How to Return Products β Contact us at support@mossnmyrtle.nz to request a return authorization number and instructions.
5.5 Refund Processing β Once we receive and inspect your returned item, we will process your refund within 5-10 business days to the original payment method.
5.6 Non-Refundable Items β Living plants (unless faulty), personalized items, final sale items, and gift cards cannot be returned or refunded except where required by law.
6.1 Limitation of Liability β To the maximum extent permitted by law, Moss & Myrtle shall not be liable for any indirect, incidental, special, or consequential damages. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under NZ law.
6.2 Website Availability β We do not guarantee uninterrupted access to our website.
6.3 Accuracy of Information β We make every effort to ensure information is accurate but do not warrant that content is error-free.
6.4 Third-Party Links β Our website may contain links to third-party websites. We do not endorse or take responsibility for their content.
6.5 Plant Toxicity Warning β Some plants may be toxic to pets or children if ingested. We provide toxicity information on product pages where applicable. Please research plant toxicity before purchasing if you have pets or children.

10.1 Entire Agreement β These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Moss & Myrtle.
10.2 Severability β If any provision is found to be invalid, the remaining provisions continue in full force.
10.3 Waiver β Our failure to enforce any right does not constitute a waiver of that right.
10.4 Force Majeure β We are not liable for delays due to circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, or government actions.
